ObamaCare fines rising in 2015, IRS prepares to collect

Don't have health insurance? Get ready to pay up. 
The ObamaCare-mandated fines for not having insurance are rising in 2015 -- and for the first time, will be collected by the Internal Revenue Service. 
The individual requirement to buy health insurance went into effect earlier this year. But this coming tax season is the first time all taxpayers will have to report to the IRS whether they had health insurance for the prior year. 
The fines for the 2014 year were relatively modest -- $95 per person or 1 percent of household income (above the threshold for filing taxes), whichever is more. 
But insurance scofflaws face a sharp increase if they don't get covered soon. The fine will jump in 2015 to $325 or 2 percent of income, whichever is higher. By 2016, the average fine will be about $1,100, based on government figures. 
The insurance requirement and penalties remain the most unpopular part of the health care law. They were intended to serve a broader purpose by nudging healthy people into the insurance pool, helping to keep premiums more affordable. But the application of fines in 2015 could renew criticism of the law, at a time when Republicans are taking control of Congress and looking at ways to undercut the policy. 
According to government figures, tens of millions of people still fall into the ranks of the uninsured. 
Unclear is how many would actually be assessed a fine. The law offers about 30 different exemptions, most of which involve financial hardships. Further, it's unclear how aggressively the IRS would go after the fines. 
Many taxpayers may be able to get a pass. 
Based on congressional analysis, tax preparation giant H&R Block says roughly 4 million uninsured people will pay penalties and 26 million will qualify for exemptions from the list of waivers. 
Deciding what kind of waiver to seek could be crucial. Some can be claimed directly on a tax return, but others involve mailing paperwork to the Department of Health and Human Services. Tax preparation companies say the IRS has told them it's taking steps to make sure taxpayers' returns don't languish in bureaucratic limbo while HHS rules on their waivers. 
TurboTax has created a free online tool called "Exemption Check" for people to see if they may qualify for a waiver. Charges apply later if the taxpayer files through TurboTax. People also can get a sense of the potential hit by going online and using the Tax Policy Center's Affordable Care Act penalty calculator. 
Timing also will be critical for uninsured people who want to avoid the rising penalties for 2015. 
That's because Feb. 15 is the last day of open enrollment under the health law. After that, only people with special circumstances can sign up. But just 5 percent of uninsured people know the correct deadline, according to a Kaiser Family Foundation poll. 
"We could be looking at a real train wreck after Feb. 15," said Stan Dorn, a health policy expert at the nonpartisan Urban Institute. "People will file their tax returns and learn they are subject to a much larger penalty for 2015, and they can do absolutely nothing to avoid that." 
In a decision that allowed Obama's law to advance, the Supreme Court ruled in 2012 that the coverage requirement and its accompanying fines were a constitutionally valid exercise of Congress' authority to tax. 
Sensitive to political backlash, supporters of the health care law have played down the penalties in their sign-up campaigns. But stressing the positive -- such as the availability of financial help and the fact that insurers can no longer turn away people with health problems -- may be contributing to the information gap about the penalties.

NEW YORK CITY — WhileMayor Bill de Blasio was personally coaxing the city’s police union presidents to meet with him, his top aides were on the phones with lawmakers urging them to blast PBA President Patrick Lynchand other officers for turning their backs on the mayor following the assassinations of two of New York’s Finest, DNAinfo New York has learned.
As late as Monday afternoon — the same time de Blasio was speaking with police union leaders to set up Tuesday's détente to possibly mend their fractured relationship — the mayor’s government affairs honchos were privately cold-calling the city’s Democratic delegation of city and state elected officials, asking them to publicly criticize Lynch and those officers who dissed the mayor.
“City Hall wanted me to blast the Patrolmen’s Benevolent Association for turning their backs on him,” a Big Apple legislator told “On The Inside.” “They called up Monday, said they were calling all of us, and that it was our obligation to stand up defending the mayor."
There was an expectation from City Hall that "because they were calling that we should do whatever they ask," the lawmaker said.
Another lawmaker, who also received a call from a top City Hall official, said he did not feel pressured to speak out, but thought it was "really inappropriate" to be asked even though he did not agree with the police protests.
"I think the mayor should not find himself in that position, particularly on an issue that is so sensitive, asking elected officials to chime in on something like this," he said. "It is not really appropriate and I felt badly that they had to do it."
He was already leaning toward making a public statement, but declined to say whether he actually did.
A City Hall spokesman did not immediately return a call seeking comment. The heads of the city's police unions were not immediately available as well.
Immediately following the murder of officers Rafael Ramos and Wenjian Liu on Dec. 20, Lynch and other officers at Woodhull Hospital turned their backs on de Blasio when he showed up to meet with the slain officers' families and host a press briefing on the incident.
A large contingent of police officers also turned their backs Saturday during Ramos's funeral when an outdoor Jumbotron broadcast de Blasio's eulogy.
Police union bosses believe the mayor has long held anti-police positions, and that they, coupled with his kid-glove treatment of recent protesters, have contributed to an incendiary climate that led to the police executions.
The two lawmakers said most of their colleagues who they spoke to felt like they were not going to take the bait from de Blasio's team.
“The mayor’s people said that this had nothing to do with politics, so I said, 'then what is the purpose of this call?’” one of the lawmakers added.
Sources say that over the weekend City Hall officials desperately tried to find out if a large scale protest was planned for Monday’s police graduation at Madison Square Garden. No such demonstration took place, and the mayor was only jeered briefly during his speech and a smattering of people turned their backs during his address to the new officers.
None of the cadets turned their backs on the mayor.
On Sunday, de Blasio telephoned the police union leaders to broker Tuesday's summit. The leaders were skeptical of what they feared were political motives behind the meeting, but said they would attend, but only if all five agreed to be there, sources said.
Then on Monday, Lynch and Ed Mullins, the head of the sergeants union, who are they mayor's harshest critics, signed on for the meeting. Police Commissioner William Bratton was also scheduled to attend.
UPDATE: Mayor Bill de Blasio's press secretary Phil Walzak emailed a response to DNAinfo after this story was published.
Walzak confirmed that de Blasio aides cold called city Democrats but insisted they "did not ask elected officials to 'attack' anyone," and only requested the politicians "support the families" of the slain NYPD officers.
Asked about Walzak's claim, one of the lawmakers who received a call said it was "preposterous" and "not reality."

President Obama has thoroughly trampled the Constitution during his presidency. Even the strictest liberals, as a whole, do not deny that the president overstepped his constitutional limitations by granting amnesty via executive fiat; they simply maintain that the ends justified the means.
There is a power that the president holds, however, that can stop legislation in its tracks thatis constitutional- his power of the veto.
Unfortunately for America, the president who has few qualms about defying the law by granting amnesty will have even fewer qualms about vetoing legislation that comes across his desk that does not jibe with his radical agenda.
The president-turned-emperor issued a warning to incoming Republicans in an NPR issue airing on Monday. With Democrats suffering massive losses in November, both the Senate and the House will be controlled by Republicans come January- a fact that Obama speculates will cause him to get busy vetoing.
The man who has repeatedly claimed that he’s willing to work with Republicans high-handedly warned,
“I haven’t used the veto pen very often since I’ve been in office. Now, I suspect, there are going to be some times where I’ve got to pull that pen out.”
He added: “I’m going to defend gains that we’ve made in health care. I’m going to defend gains that we’ve made on environment and clean air and clean water.”
Obama has only vetoed two pieces of legislation since arriving in office; however, he has enjoyed the benefit of having a Senate and, for a time, House controlled by equally-radical Democrats.
To overturn the veto, Republicans would have to have a two-thirds majority approve the reversal. While GOP majorities are not that large, Democrats have broken rank in recent months to distance themselves from Obama and his disastrous agenda that the majority of Americans have soured on. While breaking rank and defying a presidential veto is not common, in this political atmosphere, it may be safe as nobody wants to be seen as an obstructionist.
The onus will soon be on President Obama to explain that, for years, he has postured as if Republicans are only interested in obstructing government, but as Republicans pass legislation, he is willing to stand in the way of such bills becoming laws.
If history is any indication, however, the mainstream media will likely refuse to shine a light on the president’s policy of obstruction and his enduring hypocrisy.

New York City Mayor Bill de Blasio has been in the news of late for his inept mishandling of the deaths of two NYPD officers, Wenjian Liu and Rafael Ramos, but that is the tip of the iceberg.
Judicial Watch has uncovered documents that show de Blasio was an ardent supporter of the brutal communist Sandinista regime, even going so far as to travel to the country’s capital, Managua, to provide aid.
Upon his return to New York, de Blasio joined the Nicaragua Solidarity Network of Greater New York (NSN).
According to their own records, the aim of the NSN was to, “…support the Sandinista Revolution and to protest U.S. support of the counter-revolutionary military movement, aka the Contras, who also killed civilian supporters of the revolution, targeting medical and educational personnel in particular.”
It’s no wonder that Bill de Blasio has tried to keep this under wraps.
Yet when confronted with the truth, Mayor de Blasio is unapologetic for supporting one of the most ruthless and brutal Marxist political movements, responsible for the deaths and disappearances of thousands of people.
“By 1983 there were about 20,000 political prisoners held in the Marxist regime’s jails,” said the Judicial Watch report. “The highest number of political prisoners of any nation in the hemisphere with the exception of Fidel Castro’s communist Cuba.”
Strange how Democrats like de Blasio and Obama feel it’s ok to have normal relations with human rights violators, Nicaragua and Cuba, yet are adamant on setting free radical Islamic terrorists from our prison at Guantanamo.

Top New York pol under federal investigation

Although not well-known outside New York, Sheldon Silver, speaker of the New York State Assembly for the last two decades, is one of the most powerful politicians in the country.  And he is now under investigation by the feds for what looks like pretty serious scandal, according to the New York Times.  Three reporters, William K. RashbaumThomas Kaplan, and Susanne Craig, are on the story, meaning this is a big one.
Federal authorities are investigating substantial payments made to the State Assembly speaker, Sheldon Silver, by a small law firm that seeks real estate tax reductions for commercial and residential properties in New York City, according to people with knowledge of the matter.
Prosecutors from the United States attorney’s office for the Southern District of New York and agents of the Federal Bureau of Investigation have found that the law firm, Goldberg & Iryami, P.C., has paid Mr. Silver the sums over roughly a decade, but that he did not list that income on his annual financial disclosure forms, as required, the people said.
The prosecutors, from the office of the United States attorney, Preet Bharara, and the F.B.I. agents were seeking to determine precisely what Mr. Silver, a Manhattan Democrat, has been doing for the payments, the people said. Spokesmen for the F.B.I. and Mr. Bharara’s office declined to comment.
At stake is a lot more than just Silver, important though he is:
The investigation into the Goldberg firm’s payments to Mr. Silver grew out of the work of the Moreland Commission, an anticorruption panel that Gov. Andrew M. Cuomo, a Democrat, created in 2013 but abruptly shut down in March. Before it was shut down, the commission had investigated how lawmakers earn money outside of Albany, though the inquiry was stymied by a legal challenge from lawmakers and their employers.
The shutdown of the Moreland Commission itself is a major scandal, and if the feds bring an indictment and get a conviction, then Cuomo’s action will be shown to have shielded at least one lawbreaker, raising the question of what else he was covering up.  To put it mildly, New York State has never been regarded as an exemplar of good government, and once rocks start getting overturned, who knows what will come crawling out?
Among the suspicious circumstances:
He [Silver] is not known to have any expertise in the complex and highly specialized area of the law in which Goldberg & Iryami practices, known as tax certiorari, which involves challenging real estate tax assessments and seeking reductions from municipalities.

For his part-time legal practice (while serving as speaker), Silver has done very well indeed:
Law firms that practice this sort of law typically get paid on a contingency fee basis, meaning they keep a share (often one third) of the tax savings they realize for their clients.  When tax bills run into the millions, as they do on many New York properties, the legal fees beat the heck out of an hourly billing system, even at 500 bucks an hour.

Mr. Silver’s income from his private law practice well exceeds his legislative salary, which as speaker totals $121,000. On his most recent financial disclosure form, for 2013, he reported earning more than $650,000 from his outside legal work. But what he does to earn that money has long been shrouded in secrecy.
Nice income for a part-time job!
Keep your eyes on this one.  If Eric Holder’s successor doesn’t shut it down, this investigation could lead to some interesting places, what with the prospect of offering immunity in return for implicating others.  The fact that the investigation has been leaked to the New York Times suggests to me that canny federal prosecutors, well aware of the potential for making names for themselves by bagging some really prominent scalps in a political corruption prosecution, have just taken out an insurance policy against a shutdown from on high in the Justice Department.  Holder’s successor nominee, Loretta Lynch, will, after all, face confirmation hearings from a Republican-controlled Senate.

Jason Riley: Get Ready For A ‘State Of The Union’ Lecture On Racism

Fox News political analyst and Wall Street Journal editorial board member Jason Riley isn’t one to pull punches.
When asked Sunday what his number one 2015 political prediction is, Riley said “Barack Obama, our twice-elected black president, will use his state of the union address to lecture America on the persistence of racism.”
Fox News Sunday host Christopher Wallace followed up by asking Riley if he thought Obama plans to “talk about issues of responsibility in the black community?”
“No, he will not,” Jason Riley responded.
I tend to agree.
Obama has teamed up with Al Sharpton, fully revealing his intentions to divide the country up on racial and partisan lines.
However, Jason and I could be wrong.

Over 90 Percent Of Illegals Who Crossed The Border This Summer Skipped Immigration Hearings

When asked what should happen to the tens of thousands of illegal immigrants, many of them children, who surged across the border earlier this year, leading immigration activists like Rep. Luis V. Gutiérrez (D-IL) stressed that they “get their day in court as the law mandates.”
“It is just common sense.  No child should appear in immigration court and be expected to advocate for themselves,” Gutiérrez said in a statement signed by several other Congressmen.
However, as Houston’s KPRC reports, a majority of those thousands of Central American illegal immigrants who were supposed to show up at deportation hearings and be deported or granted asylum never did.
Of the completed cases of immigrants who were released over a three-month period, more than 90 percent of them never showed up for their immigration hearings.
According to the Executive Office of Immigration Review, which tracks those individuals caught crossing the border, of the 15,614 families caught crossing the border, 4,197 have been ordered removed from the country–and a whopping 96 percent who received removal orders, never came to court.
It is now up to the already thinly spread federal investigators to capture these individuals before they become permanent members of those illegal immigrants who are often deemed to be living “in the shadows.”
Here’s how the Department of Homeland Security responded to KPRC’s report.
Officials with the Department of Homeland Security reiterated all those caught crossing the border after Jan. 1 are a top priority to have their cases decided in immigration court and to track down those who’ve disappeared.

An 'Awesome Economy'? Not Even Close

"Everything is awesome", stated the headline of a recent Politico piece by Michael Grunwald which goes on to list many economic statistics showing how well things are going in the U.S.
Indeed, some economic indicators are now better now than when compared to the height of the crisis, but those conditions were bound to change just as most of the water in New Orleans following Hurricane Katrina receded without anyone doing much to encourage it. All the same, current claims of doing “better” than during the depth of a major recession hide how bad things still are compared to before the crisis. Here are some examples:
  • While crashing in recent months, gas prices at the pump still averaged this year above the pre-Obama annual averages.
  • The Deficit for the just-concluded Federal budget year was larger (in both dollar terms and as a percent of the economy) than in the years before the crisis.
  • Sales of existing homes are weaker than from before the bubble era, and sales of newly-built homes in 2014 was still weaker than all but two of the 45 years (!) leading up to Obama.
  • The Unemployment Rate for all of 2014 is on pace to be worse than any annual average under Bush and worse than most Clinton years as well.
  • Household Income is 4.5% lower compared to when the previous recession started seven years ago.
  • The Poverty Rate -- the percent Americans living in poverty -- is worse than any year under Bush and worse than most Clinton years too despite the fact that the elevated Obama government spending for the poor suppresses the real poverty rate.
  • The economy over the last twelve months ending in September rose by $727 billion (in raw dollars) but only after the Federal Reserve pumped $710 billion into the economy during the same period. The 120 days it took for the Dow to jump from 17K to 18K gave people some tickles but it is almost five times longer than the 26 days it took for the Dow to jump from 13K to 14K before the last recession.
  • The Economic Stress Index in Obama's first year was indeed at a devastating record high of 19, yet the Index is closing 2014 at an elevated 8. While this is a big improvement, it is still weaker than the four years leading up the recession (2004-2007) when the Index averaged annually a 5. The same four years under Clinton, the Index averaged a 3 and the same years under President Reagan it averaged a 4.
Why is the stress index still elevated?
1) GDP/economic growth is weaker now than in previous recoveries despite the fact that the Fed is still underpinning the economy with a $4.5 trillion balance sheet. If things were “awesome” or even close to good, the balance sheet could have been cut back to the minimal $800 billion (1/5 the current size!) it was before the crisis. But things are obviously not awesome.
2) The Underemployment Rate (U6) is still very elevated. The U6 is the broadest view of the employment situation because it counts the regular unemployed (reflective in the official Unemployment Rate) plus those desultorily looking for jobs, plus those who have only part-time jobs because the economy does not provide them a full-time job. The U6, along with the regular Unemployment Rate, does not count those who completely dropped out of the workforce because they gave up. Despite those missing millions, the U6 is still elevated.

Essentially, the narrow-area data points outlined above and the broad data points reflective in the Economic Stress Index are all still weak compared to the years or decades before Obama came in. Using 2009 as a starting point to measure current levels of “success” is flawed or at best simply misleading, because the depth of the crisis was never bound to remain the same forever. In fact, months into the crisis and shortly before Obama took office, the CBO projected that the economy in the four years 2011 through 2014 would grow annually at 4%, but we have not gotten anywhere close to those growth numbers.3) Household Income is trailing badly. Yes, the economy is adding jobs but too many of those are part-time jobs, and many jobs -- including full time -- are paying bubkes; hence household income is still weak. In November, household income was 2.7% lower than when the recession “ended” in June of 2009 according to the widely-accepted Sentier Research, and it is 4.5% worse than when the recession started.

Media refuses to report on white cop that was kidnapped/murdered by blacks


Imagine if four white police officers kidnapped and murdered a black male. It would be the biggest news story in America for a year.
Yet last January four black males actually kidnapped a white Waynesboro, VA police officer and murdered him. It has been a heavily censored “hush crime.” Even local media pieces censored all details about the perps. The media desperately doesn’t want the public to know. Only websites, such as this one have covered it.
However, a small daily paper out of Lowell, Massachusetts published a letter to the editor about the racial hate crime murder this weekend.
Do not underestimate the power of letters to the editor. More people read letters to the editor than the news. All conservative activists should consider sending letters to the editor to their local papers.
Earlier this year in Virginia, Waynesboro police officer Kevin Quick was kidnapped and murdered by four black gang members with affiliation to a national gang from Los Angeles. Quick was driven from ATM to ATM where he was made to withdraw money, then driven into the woods where he was executed as a way for the murderers to move up in the gang.
Nowhere in the national media was this murder of a police officer put to paper. But when a white police officer shot a black man named Michael Brown in Missouri, it made the national news for months. What hypocrites the media has become. Where is the outrage for Quick? Where are the beserk protesters burning and looting in the name of officer Quick?
Where is the white outrage? Where is the hatemonger Al Sharpton?
What if white supremacists, Nazis or the Ku Klux Klan showed up in Virginia and began to riot like the socialist and communist thugs in Ferguson and St. Louis? Would they say the police overacted when they dragged those white thugs away? I don’t think so.
But I guess it is OK to kill a police officer, especially a white one.
If the mainstream media had any courage, they’d put Quick’s story out for consumption right next to the skewed story of the black teen from Ferguson.
But in the eyes of the liberal media elite, when you control the press, you control the message. Quick didn’t deserve what happened to him any more than Brown did, but I don’t hear any wailing for the cop. What a sick country we’ve become.

In an interview with National Public Radio, President Barack Obama sounded off on the defeat handed to his party on Election Day earlier this year and said Democrats may have fared better if they had ran on his “great record.”
“[I] think the circumstances will have changed, though,” Obama said. “I’m obviously frustrated with the results of the midterm election. I think we had a great record for members of Congress to run on, and I don’t think we — myself and the Democratic Party — made as good of a case as we should have. And, as a consequence, we had really low voter turnout and the results were bad.”

Demonstrators who joined the “after-party” of the “Millions March” in Los Angeles on Saturday burned a flag in the heart of Hollywood on Saturday evening as a protest against the death of black suspects at the hands of police. The ‘Black Lives Matter’ demonstrators also blocked traffic at the intersection of Hollywood Boulevard and Highland Avenue, according to social media tracked by Twitchy, where police officers had shot and killed a man earlier in the month who was allegedly armed.

The protestors alleged that a car broke through their human chain across Hollywood Boulevard, injuring one demonstrator. In other ‘Black Lives Matter’ demonstrations, notably in Oakland, marchers threw themselves on the hoods of police cars and then claimed to have been assaulted–a tactic captured on live streaming and viewed in real-time by Breitbart News.
The Hollywood protest was an offshoot of the earlier, legal, organized and orderlydemonstration covered by Breitbart News in West Los Angeles. Another demonstration at the same location earlier in the month had also burned an American flag.
