 Jack Smith’s attempt to jail Donald Trump is already facing major hurdles.

There is one ticking time bomb that worries Democrats.

And Matt Gaetz uncovered one secret that could destroy Jack Smith’s case against Trump.

Florida Congressman Matt Gaetz (R-FL) dispatched a letter to Jack Smith demanding Smith turnover to Congress the roster of prosecutors Smith enlisted for the witch hunt against Donald Trump.

“It should be obvious that doing due diligence in vetting an office that has apparently done no vetting of its own personnel, or worse, might affirmatively be seeking to staff with sanctioned lawyers and partisan hatchet-men (and women), is an entirely appropriate purpose and one small reason I am requesting this information,” Gaetz wrote to Smith.

Gaetz wrote the letter after discovering that former Obama Justice Department prosecutor Karen Gilbert worked as part of Smith’s team.

Gilbert resigned as chief of the narcotics section of the Miami U.S. Attorney’s office in 2009 after implementing a scheme to wiretap a defense attorney as part of drug prosecution against a local doctor.

The government accused Dr. Ali Shaygan of 141 counts of illegally distributing pain killers.

Without the approval of her boss, Gilbert signed off on a wiretap of Shaygan’s defense lawyer after the government suspected witness tampering.

The wire tap turned up nothing.

A jury then acquitted Shaygan on every single count.

The Justice Department apologized, writing “The government acknowledges and deeply regrets that it made serious mistakes.”

And the judge in the case accused the government of acting in “bad faith” and “gross negligence” while also ordering the Justice Department to pay Shaygan $601,795 in restitution for legal fees.

In an interview with the New York Post, Shaygan slammed the idea that Smith would bring on Gilbert as part of the team investigating Trump.

“I have no reason to believe that she will behave ethically in any circumstance,” Shaygan told the Post. “I do not find it appropriate for her to still be employed by the Department of Justice.”

“She was a sorry sack of lies,” Shaygan added.

Trump’s lawyers will try to get the case dismissed on the grounds of prosecutorial misconduct.

The most damning example was the accusation made by Stanley Woodward, the lawyer for Trump’s co-defendant Walter Nauta.

Woodward wrote in a sworn statement to the Washington, D.C. Circuit Court that Smith prosecutor Jay Bratt threatened Woodward that a judgeship he applied for could fall through unless he convinced Nauta to flip on Donald Trump.

Trump attorney Timothy Palatore revealed that during his testimony to the grand jury Smith’s prosecutor’s committed 45 different acts of prosecutorial misconduct by trying to pierce attorney client privilege with their questions and then using Palatore’s refusal to answer to prod the grand jury to think Trump was guilty.

There is a chance Smith’s case never sees trial.

And the conduct of Smith’s prosecutors could lead to Judge Aileen Cannon throwing the whole case out.
