New York Gov. Kathy Hochul Shows Once Again How Much She Despises the Second Amendment

New York’s government just can’t get enough gun control laws. Despite the Supreme Court’s ruling in New York Rifle & Pistol Association v. Bruen, the state’s government continues to impose policies aimed at subverting the court’s decision while cracking down on gun rights.

Gov. Kathy Hochul on Wednesday signed into law a series of useless gun restrictions that will only protect violent criminals. The laws are ostensibly intended to reduce gun violence through enhanced education on firearms, more regulations on gun dealers, and stricter tracking of gun sales.

“I am proud to sign this bill package that will help enhance safety across New York,” Hochul said. “While we are taking expedient action to enhance New York State's nation-leading gun laws, we recognize that gun violence is a nationwide problem. I once again urge Congress to follow our lead and take immediate action to pass meaningful gun violence prevention measures. Lives depend on it.”

The legislative package includes several provisions aimed at restricting the right to keep and bear arms. Among the laws is a requirement for firearms dealers to post signage warning about the risks associated with owning guns, such as increased risk of suicide, domestic violence fatalities, and accidental deaths among children. The signs must provide contact information for the National Suicide Prevention Lifeline.

The laws also require credit and debit card companies to apply a merchant code for businesses whose primary source of revenue is the sale of firearms, ammunition, or accessories. Those who violate this law could face fines of up to $10,000. The law is intended to make it easier to track gun-related sales and to make it easier for law enforcement to monitor “suspicious” transactions.

The legislative package also beefs up the state’s red flag laws. Courts will be required to notify the statewide registry when issuing an Extreme Risk Protection Order (ERPO), either temporarily or permanently. The law also empowers police agencies, instead of individual officers, to be listed as petitioners in ERPO proceedings to streamline the process for police to confiscate firearms if they determine that someone poses a threat to themselves or others.

Former Arizona Rep. Gabby Giffords, a prominent anti-gunner activist, lauded the measures. “New Yorkers deserve to live free from the fear of gun violence,” she said. “The bills signed into law today by Governor Hochul will make New York safer and undoubtedly save lives.”

The governor touted New York’s supposed successes in reducing gun violence, noting that shooting incidents with injuries in communities participating in the state’s Gun Involved Violence Elimination (GIVE) initiative have dropped by 47 percent since 2021. Law enforcement agencies have seized over 7,700 illegal firearms this year, including 569 so-called ghost guns.

"Gun violence is an epidemic that is tearing our country apart," Hochul asserted. "Thoughts and prayers won’t fix this, but taking strong action will.”

Both Hochul and Giffords are either living in a fantasyland or are blatantly lying to the public. None of these laws will keep people safe. In fact, it is more likely they will make people more vulnerable by making it difficult for people to possess firearms. Indeed, it remains a challenge to obtain a permit to carry a gun despite the Bruen ruling. The only people this legislative package will benefit are the government and violent criminals – two terms that have become redundant.
