Alvin Bragg Gets Bad News, Federal Judge Denies Attempt to Block Ex-Prosecutor's Testimony on Trump Case

 On Wednesday, a federal judge rejected Manhattan District Attorney Alvin Bragg’s effort to prevent former assistant district attorney Mark Pomerantz from testifying before the House Judiciary Committee regarding the criminal case against former President Donald Trump.

The committee, led by its chairman, Rep. Jim Jordan (R-Ohio), had subpoenaed Pomerantz to provide testimony about the DA’s investigation into Trump, which resulted in the former president’s indictment in March.

Bragg filed a lawsuit against Jordan and the Judiciary Committee, asserting that the subpoena was an overreach by the GOP-led House and an attempt to influence a state criminal proceeding.

However, Judge Mary Kay Vyskocil ruled that the subpoena had been issued with a “valid legislative purpose” and that it was not within the purview of the federal judiciary to dictate how Congress operates.

In her opinion issued after a Manhattan federal court hearing, Vyskocil wrote, “Mr. Pomerantz must appear for the congressional deposition. No one is above the law.”

Pomerantz is scheduled to give the deposition on Thursday morning unless Bragg’s office secures a delay from a federal appeals court.

Rep. Jordan issued the subpoena ostensibly to investigate whether and how federal funds were utilized in the investigation into Trump by Bragg’s office.

Pomerantz left the office and authored a tell-all book that detailed an earlier grand jury inquiry into Trump, which ultimately did not result in charges against the former president.
