Former Director of National Intelligence Tulsi Gabbard said in a social media post on Saturday that Dr. Anthony Fauci, the architect of the COVID-19 pandemic and vaccine disinformation chief, could still be prosecuted after she released evidence that he lied to Congress about COVID-19 origins and US funding of gain-of-function research.
Fauci received a sweeping pardon from Joe Biden in January 2025, shielding him from prosecution for crimes he committed between 2014 and 2025. The Department of Justice claims an investigation into the legitimacy of Biden’s pardons remains ongoing. Thousands of acts of clemency and executive actions were signed with an autopen rather than a wet signature under Biden, and his aides wielded the authority without his knowledge.
Responding to criticisms that she didn’t “create a path” to prosecute Fauci on X, Gabbard wrote, “He lied to Congress in 2024. There is a path.”
As the Gateway Pundit reported, Gabbard on Thursday released “never-before-seen” documents exposing Fauci’s role in the COVID cover-up and fraudulent Intelligence Community reports on COVID’s origins. The dangerous gain-of-function research that led to the viral outbreak was linked to Big Pharma’s “pursuit of universal vaccines worth trillions of dollars,” Gabbard said.
“Before the COVID pandemic, Dr. Fauci, as head of the National Institute of Allergy and Infectious Diseases, provided millions in US taxpayer dollars to fund dangerous gain-of-function research on bat coronaviruses at the Wuhan Institute of Virology, work which is now widely viewed as the source of the unintentional lab leak that sparked the pandemic,” Gabbard said in a video statement, announcing her latest declassification.
“Politicized self-serving leaders like Dr. Fauci covered up their own wrongdoing and abuses of power, manipulated intelligence, lied to Congress, and undermined a duly elected president by restricting his access to the vital facts he needed to keep the country safe. It’s time you know the truth.”

Gabbard also released the hundreds of declassified emails after a yearlong declassification review. Earlier in the week, the Office of the Director of National Intelligence published declassified documents detailing US concerns with Ukrainian biolabs amid the Russia-Ukraine war, US funding and building of labs in Ukraine, and the diseases, including highly infectious viruses, that the US paid Ukrainian scientists to study.
Senator Rand Paul has referred Dr. Fauci to the Department of Justice for prosecution multiple times over the years.
Previously, Rand Paul referred Fauci to the Department of Justice for prosecution following his 2021 testimony on the NIH’s role in funding gain-of-function research at the Wuhan lab.
He announced in July 2025 that he would reissue the criminal referral after the New York Times confirmed that Fauci's autopen pardon was approved by White House Chief of Staff Jeff Zeints, not Joe Biden.
Then, in May 2026, Paul blasted the Department of Justice, warning they had "ONE WEEK left to charge Anthony Fauci for the worst cover-up in modern medical history" due to the statute of limitations.
Paul called out the DOJ again on Thursday when Gabbard dropped the receipts of Fauci's lies, suggesting he will maximize pressure to have Fauci prosecuted, writing, "More to come."
